I agree with Silex. Don't think it's a real bug, just an unfortunate accident.
So, should be not necessarly fixed. However, it might be fixable with speeders like Aoe mentioned.
Added (force 1) speeders there like in the screenie.
Moving this to fixes, although I'm personally not for fixing.

For me it's pretty clear that you can fail there (and it's easy to not fail).
